1. Information You Provide Us: 

 

a. Account Information: Some information is required to create an account on our Services, such as your name, email address, password, date of birth, gender, height, weight, and in some cases your mobile telephone number. This is the only information you have to provide to create an account with us. You may also choose to provide other types of information, such as a profile photo, biography, country information, and community username.

b. Additional Information: To help improve your experience or enable certain features of the Services, you may choose to provide us with additional information, like your logs for food, weight, sleep, water, or female health tracking; an alarm; and messages on discussion boards or to your friends on the Services. You may also connect with friends on the Services or invite friends who have not yet joined by providing their email addresses, accessing social networking accounts, or using the contact list on your mobile device. We do not store your contact list and delete it after it is used for adding contacts as friends. If you contact us or participate in a survey, contest, or promotion, we collect the information you submit such as your name, contact information, and message.

c. Payment and Card Information: Some BreathAI devices support payments and transactions with third parties. If you activate this feature, you must provide certain information for identification and verification, such as your name, credit, debit, or other card number, card expiration date, and CVV code. This information is encrypted and sent to your card network, which upon approval sends back to your device a token, which is a set of random digits for engaging in transactions without exposing your card number. For your convenience, we store the last four digits of your card number and your card issuer’s name and contact information. You can remove the token from your account using your account settings. We do not store your transaction history. If you purchase BreathAI merchandise on our website, you provide your payment information, including your name, credit or debit card number, card expiration date, CVV code, and billing address. We do not store this payment information. We store your delivery address to fulfill your order. Note that third-party payment processors may retain this information in accordance with their own privacy policies and terms.

 

2. Information We Receive From Your Use Of Our Services

 

a. Device Information: Your device collects data to estimate a variety of metrics like the calories burned, weight, heart rate, sleep stages, active minutes, and location. When your device syncs with our applications or software, data recorded on your device is transferred from your device to our servers.

b. Geolocation Information: The Services include features that use precise geolocation data, including GPS signals, device sensors, Wi-Fi access points, and mobile mast IDs. We collect this type of data if you grant us access to your location. You can always remove our access using your BreathAI device or mobile device settings. We may also derive your approximate location from your IP address.

c. Usage Information: When you access or use our Services, we receive certain usage or network activity information. This includes information about your interaction with the Services, for example, when you view or search content, install applications or software, create or log into your account, pair your device to your account, or open or interact with an application on your BreathAI device. We also collect data about the devices and computers you use to access the Services, including IP addresses, browser type, language, operating system, BreathAI or mobile device information (including device and application identifiers), the referring web page, pages visited, location (depending on the permissions you have granted us), and cookie information.

d. Information We Receive From Third Parties: If you choose to connect your account on our Services to your account on another service, we may receive information from the other service. For example, if you connect to Facebook or Google, we may receive information like your name, profile picture, age range, language, email address, and friend list. You may also choose to grant us access to your exercise or activity data from another service. You can stop sharing the information from the other service with us by removing our access to that other service. We may partner with third parties, such as employers and insurance companies that offer BreathAI Services to their employees and customers. In such cases, those companies may provide us with your name, email address, or similar information (like a telephone number or subscriber ID) so that we can invite you to participate or determine your eligibility for particular benefits, such as discounts or free services.

 

How we use your information

 

We use the information we collect for the following purposes:

 

1. Provide And Maintain The Services: Using the information we collect, we can deliver the Services to you and honor our Terms of Service contract with you. For example, we need to use your information to provide you with your BreathAI dashboard tracking your exercise, activity, and other trends; to enable the community features of the Services; and to give you customer support. For the Services’ community features, we may use your information to help you find and connect with other users and allow others to find and connect with you. For example, your account contact information allows other users to add you as a friend. When another user has your email or mobile phone number in their contact list or their friend network on a connected service, we show that user that you are a user of BreathAI. Your settings control whether others can see your BreathAI account or contact information. We do not use your contact information to send marketing communications unless you have explicitly asked us to do so (for example, by filling out a form on our website) or as part of a specific feature (for example, when you use friend referral features).

2. Improve, Personalize, And Develop The Services: We use the information we collect to improve and personalize the Services and to develop new ones. For example, we collect heart rate information to provide you with unique insights and tips about your heart rate and to improve the accuracy of your calories burned during exercise.

3. Communicate With You: 

a. We use your information to communicate with you in the following ways:

 

i. To respond to your requests or questions. For example, we use your information to provide customer support or to contact you about your account with us.
ii. To communicate with you about BreathAI-related offers and promotions. We may communicate with you about BreathAI-related products, services, offers, promotions, or events.
iii. To send administrative information to you. We may contact you to inform you about changes in our Services, our Service offerings, and important Service-related notices, such as security and fraud notices. These communications are considered part of the Services and you may not opt out of them.
iv. To facilitate transactions and payments. We may use your information to facilitate the transaction and payment of products and services you request. For example, we may use your payment information to process and complete your transaction. When you make a payment, we may also send you a receipt.
v. To send you push notifications and in-app notifications. We may send you push notifications and in-app notifications, including to let you know when we have posted new content or new features to the Services. If you wish to opt out of these communications, you may do so by turning off push notifications in your device settings.
vi. For billing and account management. We use account data and device data to administer accounts and keep track of billing and payments.

 

4. Promote Safety And Security: We use the information we collect to promote the safety and security of the Services, our users, and other parties. When you authenticate, register, or log in, your employer or insurer can see your personal information and you will be subject to your employer’s or insurer’s privacy policies and terms of service.

2. Service Providers: We share your information with service providers who help us provide the Services. Service providers help us with things like payment processing (e.g., banks, credit bureaus, payment method providers), website hosting, data analysis, information technology and related infrastructure, customer service, email delivery, auditing, and other services.

3. Third-Party Partners and Integrations: The Services may also contain third-party links and search results, include third-party integrations, or offer a co-branded or third-party-branded service. Through these links, third-party integrations, and co-branded or third-party-branded services, you may be providing information (including personal information) directly to the third party, us, or both. You acknowledge and agree that we are not responsible for how those third parties collect or use your information. 4. Other Users: Our Services may display information like your name and email address to other users in places like your user profile and sharing notifications. Certain features let you make additional information available to other users.

 

5. Social Sharing And Other Tools: The Services may offer social sharing features or other integrated tools, which let you share actions you take on our Services with other media, and vice versa. The use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the third party that provides the social sharing feature. Your Rights To Access and Control Your Personal Data

We provide you with the ability to exercise certain controls and choices regarding our collection, use, and sharing of your information. In accordance with local law, your controls and choices may include:
 
1. Correction Of Personal Data: You can review and edit your personal data by logging into the Services and visiting your account profile page.

2. Access To Personal Data: You can request a copy of your personal data by contacting us.

3. Deletion Of Personal Data: You can request that we delete your personal data by contacting us.

4. Account Settings: You may update your account settings to control subscriptions you have made through your account and you can also opt out of receiving marketing emails from us by clicking on the unsubscribe link provided in such communications. As described above, you cannot opt out of Service-related communications (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the Services, technical and security notices).

5. Mobile Devices: We may send you push notifications through our mobile applications. You may at any time opt-out from receiving these types of communications by changing the settings on your mobile device. We may also collect location-based information if you use our mobile applications. You can opt out of this collection by changing the settings on your mobile device.

6. Do Not Track: Your browser may offer you a "Do Not Track" option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. Our Services do not support Do Not Track requests at this time. However, we provide you with choices about receiving personalized advertisements as described above. You can also exercise other controls and choices available to you as described in this Privacy Policy.

 

Data Retention

We keep your account information, like your name, email address, and password, for as long as your account is in existence because we need it to operate your account. In some cases, when you give us information for a feature of the Services, we delete the data after it is no longer needed for the feature. We also keep information about you and your use of the Services for as long as necessary for our legitimate business interests, for legal reasons, and for preventing harm, including as described in the “How information is shared” section.

 
Security

We implement security safeguards designed to protect your data, such as HTTPS. We regularly monitor our systems for possible vulnerabilities and attacks. However, we cannot warrant the security of any information that you send us. There is no guarantee that data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

 

Age Limits

To the extent prohibited by applicable law, we do not allow the use of our Services and Websites by anyone younger than 18 years old. If you learn that anyone younger than 18 has unlawfully provided us with personal data, please contact us and we will take steps to delete such information.
